DWI Part (Supreme Court, New York County)

[from NYCBA]

Greetings all:

This morning I received the following email from our Chief Administrative Judge Michael Obus. I wanted to insure everyone had this update so that we were all in the know about the new procedure being instituted at New York County Supreme:

"Dear Counsel:

As Chief Judge Lippman announced in this year's State of the Judiciary address, felony prosecutions for operating a motor vehicle while intoxicated are to be calendared in designated court parts. This is to advise you that, pursuant to this initiative, such matters in New York County are now being adjourned for Supreme Court arraignment in Part 22 (room 948 at 111 Centre Street) on its regular Wednesday calendar days, but on a separate "22 DWI" calendar.

All pre-trial proceedings in these cases will be conducted in the DWI part, but trials may be conducted in any available part.

This initiative applies to cases in which the defendant is charged only with driving while intoxicated and related offenses defined in the Vehicle and Traffic Law. All other matters will be handled as they have been in the past.

Please advise your colleagues about this procedure and let me know if you have any questions. Thank you for your cooperation.

Michael J. Obus
Administrative Judge for Criminal Matters
New York County"

Please write to me with any comments so that I may address them on our behalves.
