SURROGATE'S COURT CITATIONS
After a Petition has been filed in Surrogate's Court, all interested parties must be served with notice of the process before the court.
This notice is called a Citation and it is issued by the clerk of the court.
In providing notice, the citation gives a party the opportunity to dispute the petition that is before the court. If a person signed a Waiver of Citation (or Waiver of Process), then he or she would not need to be served with a citation.
If you ever receive a Surrogate's Court Citation, then treat it very seriously.
Consult with an attorney as soon as possible prior to the citation date. Otherwise, you will need to appear on the scheduled date and ask the court for an adjournment to retain an attorney. Failing to appear can have an adverse effect on your rights.
